6. EMBEDDED CONTENT FROM THIRD-PARTY SERVICES

When embedded content is loaded, the third-party service may process certain technical data, in particular your IP address and information about your browser or device. Depending on the service and your consent settings, cookies or similar technologies may also be used.

These services may process data in accordance with their own privacy and cookie policies.

7. COOKIES AND SIMILAR TECHNOLOGIES

7.1 What is a cookie?

A cookie is a small file stored on your computer, phone or other device when you visit a website.

Cookies make it possible, among other things, to recognise a browser, keep certain preferences, secure a session, remember a cart or measure the use of a website.

We may also use similar technologies, such as web beacons, pixels or local storage. In this policy, the term “cookies” refers, for simplicity, to all of these technologies.

7.2 Necessary, technical and functional cookies

Some cookies are essential for the website to work or allow us to provide a feature you have expressly requested. They may be used in particular to:

  • ensure the technical operation of the website;
  • maintain a user session;
  • remember certain preferences;
  • keep the products added to the cart;
  • enable the checkout process;
  • ensure the security of the website;
  • manage certain language or navigation features.

These cookies may be set without prior consent when they are strictly necessary for the requested service or for the website to work.

7.3 Statistics and audience measurement cookies

We may use statistics cookies, in particular Shopify’s analytics tools and, where applicable, Google Analytics, to understand how visitors use our website and to improve its operation and content.

Where required by applicable regulations, these cookies are only activated after your consent has been obtained.

7.4 Marketing and tracking cookies

Marketing or tracking cookies may be used to measure the effectiveness of campaigns, understand interactions with certain content or, depending on the services used, build browsing profiles to personalise content or advertising.

In particular, we use the Meta Pixel (Meta Platforms Ireland Ltd.) and Google Ads conversion tracking (Google Ireland Ltd.) to measure the effectiveness of our advertising on Facebook, Instagram and Google and to show our ads to people who may be interested. These tools record certain actions on the website, for example pages viewed, adding to cart, starting checkout and purchasing. When you place an order, certain data may be sent to Meta and Google in encrypted (hashed) form, in particular your email address or phone number, in order to link the purchase to an ad. You can refuse these cookies in the consent banner and manage your ad preferences in your Facebook or Instagram account settings and at adssettings.google.com.

These cookies are only activated in accordance with your consent choices when consent is required by applicable regulations.

7.5 Social networks

Our website may include features or content from social networks, in particular Facebook, Instagram and WhatsApp.

Loading these features may result in technical data being transmitted to the provider concerned and, depending on your settings and consent, in cookies being set or tracking technologies being used.

The providers concerned may be located in Switzerland, in the European Economic Area or in other countries, in particular the United States. They may process data in accordance with their own privacy policies.

  • accept cookies that require consent;
  • refuse non-necessary cookies;
  • customise your preferences by category;
  • change your choices later.

Cookies strictly necessary for the website to work may be set without consent where permitted by applicable regulations.

10. HOW TO DISABLE OR DELETE COOKIES

You can delete or block cookies in your browser settings, or set it to warn you when a cookie is stored or to refuse certain cookies.

Disabling certain cookies may, however, affect how the website works, in particular the cart, the checkout process or the customer account.

For detailed instructions, please consult the help section of the browser you use.

11. STATISTICS AND AUDIENCE MEASUREMENT

We use audience measurement tools to obtain statistical information on traffic and use of the website, for example: which pages are viewed, how visitors navigate the website, which features are used and how to improve performance and user experience.

Where these tools rely on cookies that require consent, they are activated in accordance with your choices.

12. PARTNERS AND SERVICE PROVIDERS

To run the website, manage orders, payments, deliveries, communications and certain technical features, we use external service providers, in particular:

Each provider processes data in accordance with its own applicable terms and privacy policies. We only share the data needed to provide the services concerned.

13. PAYMENTS

When you pay online, the data needed to process the payment is sent to the payment provider concerned. We do not have access to your full card details: they are processed by the payment provider in accordance with its own security and privacy rules.

If you use Shop Pay, Apple Pay or Google Pay, your payment and delivery data may be stored by the provider concerned in your account with that service, under its own terms.

14. DATA RETENTION

We keep personal data only for as long as necessary for the purposes for which it was collected, subject to legal retention obligations (in particular accounting and tax obligations, in principle 10 years for accounting records in Switzerland).

The retention period may depend in particular on the duration of our relationship with you, the nature of your request, the processing of your order, the need to prevent or establish abuse or disputes, and your consent where it is the basis for processing.

Cookies also have variable retention periods depending on their function and provider.

15. YOUR RIGHTS REGARDING YOUR PERSONAL DATA

Subject to the conditions and limitations provided for by applicable law, you have in particular the following rights:

  • the right to access your personal data;

  • the right to object to certain processing;
  • the right to withdraw your consent where processing is based on it;
  • the right to receive or port your data where the applicable conditions are met;
  • the right to know the main purposes and methods of the processing concerning you.

These rights may be subject to conditions and exceptions provided for by applicable law, in particular where the retention of certain data is required by law or necessary to establish, exercise or defend legal claims.

16. ACCESS OR DELETION REQUESTS

You can ask us for a copy of the personal data we hold about you, and for its correction or deletion, subject to legal obligations that may require us to keep certain information.

To exercise your rights, contact us at: admin@espressocafe.ch

We may need to verify your identity before acting on a request concerning personal data.

17. DATA SECURITY

We implement reasonable technical and organisational measures to protect personal data against loss, misuse, unauthorised access, alteration or disclosure.

Data is hosted and processed on secure platforms operated by our technical service providers. People authorised to access personal data are bound by confidentiality.

As no method of electronic transmission or storage can guarantee absolute security, we cannot guarantee total data security.

18. DATA BREACH PROCEDURE

In the event of a personal data breach likely to present a risk to the persons concerned, we will take appropriate measures in accordance with applicable law, in particular: analysing and limiting the breach, securing the systems concerned, preserving the evidence needed for the investigation, informing the persons concerned and notifying the competent authority where required by law, and implementing corrective measures.

19. AUTOMATED MARKETING AND PROFILING

We may use automated marketing tools, in particular to send the newsletter, solely for the purposes described in this policy. The newsletter is only sent to people who have asked to receive it.

We do not use personal data for profiling that produces legal or similarly significant effects for the persons concerned. Where marketing or tracking cookies are used, they are subject to the consent rules described in this policy.

20. INTERNATIONAL DATA TRANSFERS

Some of our service providers process data outside Switzerland or the European Economic Area. This is the case in particular for Shopify (Canada, Ireland and the United States), Google, Apple and Meta (in particular in the United States).

These transfers are made in accordance with the FADP and, where applicable, the GDPR: to countries recognised as providing an adequate level of protection (for example under the Swiss-U.S. Data Privacy Framework) or on the basis of appropriate safeguards, such as standard contractual clauses.

21. DATA FROM THIRD-PARTY SERVICES

Our website may receive or process certain information from third-party services when you use their features, for example when using embedded content, payment services, social networks, maps, videos or audience measurement tools. This processing is carried out in accordance with the features enabled and your consent choices where consent is required.

22. CHANGES TO THIS POLICY

We may change this policy to reflect changes to our website, services, providers or applicable regulations. The version published on this page is the version in force.
